Draft pending legal review

This document is a structurally complete draft prepared for review. It has not yet been approved by legal counsel and is not a final, binding legal text. For any binding information, contact hello@simplaq.com.

This policy explains how Simplaq LLC ("we") handles personal data in connection with the website mallwebsite.com and the services offered through it.

1. Controller

Simplaq LLC, 651 N Broad St, Suite 201, Middletown, DE 19709, USA. EIN: 37-2042362. Contact: hello@simplaq.com.

2. What data we collect

  • Data you submit in the contact form: shopping center name, current website, city, contact person, email address, phone number (optional) and your message.
  • Data you send us directly by email, together with any project materials you share with us.
  • Technical data processed by our hosting provider when your browser requests a page, such as IP address, user agent, requested URL and timestamp.

3. Why we use it

  • To answer your enquiry and prepare an offer (performance of, or steps prior to, a contract).
  • To deliver and support a project you have ordered (performance of a contract).
  • To keep the website secure and available, including rate limiting of form submissions (legitimate interest).
  • To comply with accounting and tax obligations (legal obligation).

We do not sell personal data and we do not use it for automated decision-making or profiling.

4. Processors we use

  • Hosting and edge delivery of the website and its serverless functions.
  • Resend (email delivery) to transport contact form submissions to our mailbox.
  • Email and productivity services used to communicate with you.

Processors act only on our instructions under a data processing agreement. Because we are a US company, data may be processed outside the EEA; transfers rely on the appropriate safeguards offered by the relevant provider.

5. Retention

Enquiries that do not lead to a project are deleted once they are no longer needed for the conversation. Project and billing records are retained for the periods required by applicable accounting and tax law.

6. Your rights

Depending on where you live, you may have the right to access, rectify, erase, restrict or port your data, to object to processing based on legitimate interests, and to lodge a complaint with a supervisory authority. See our GDPR information for details and how to exercise them.

7. Cookies

Cookie and local storage usage is described on the cookie information page.

8. Changes

We update this policy when our processing changes. The date at the top of the page reflects the last revision.
